Notice"},"content":{"rendered":"<h1>Civil Rights (ADA, EEO, Title VI)<\/h1>\n<h2 class=\"text-brand-blue h2-margins-vertical-equal\">Americans with Disabilities Act (ADA)<\/h2>\n<h3 class=\"p1\"><span class=\"s1\">Notice Under The Americans With Disabilities Act (ADA)<\/span><\/h3>\n<p class=\"p1\"><span class=\"s1\">In accordance with the requirements of Title II of the Americans with Disabilities Act of 1990 (\u201cADA\u201d), and the Rehabilitation Act of 1973, Bi-State Development d\/b\/a Metro Transit will not discriminate against qualified individuals with disabilities on the basis of disability in its services, programs, or activities.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Employment:\u00a0<\/b>Metro Transit does not discriminate on the basis of disability in its hiring or employment practices and complies with all regulations promulgated by the U.S. Equal Employment Opportunity Commission under Title I of the ADA.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Effective Communication:\u00a0<\/b>Metro Transit will generally, upon request, provide appropriate aids and services leading to effective communication for qualified persons with disabilities so they can participate equally in Metro Transit\u2019s programs, services, and activities, including qualified sign language interpreters, documents in Braille, and other ways of making information and communications accessible to people who have speech, hearing, or vision impairments.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Modifications to Policies and Procedures:\u00a0<\/b>Metro Transit will make all reasonable modifications to policies and programs to ensure that people with disabilities have an equal opportunity to enjoy all of its programs, services, and activities.\u00a0For example, if a passenger cannot reach or insert a fare into the farebox, the operator may handle the fare, so long as the operator is not required to reach into pockets or backpacks to retrieve the fare.<\/span><\/p>\n<p class=\"p1\" style=\"text-align: left;\"><span class=\"s1\">Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a program, service, or activity of Metro Transit, should, as soon as possible, but, when feasible, no later than 48 hours before the undue financial or administrative burden.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Complaints that a program, service, or activity of Metro Transit is not accessible to persons with requirements of the Americans with Disabilities Act of 1990 (\u201cADA\u201d) and the Rehabilitation Act of 1973.<span class=\"Apple-converted-space\">\u00a0<\/span>It may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability in the provision of services, activities, programs, or benefits by Bi-State Development d\/b\/a Metro Transit.\u00a0<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">The complaint should be in writing and contain information about the alleged discrimination such as name, address, phone number of The complainant will receive an acknowledgement letter within ten (10) days of our receipt of the complaint informing him\/her whether the complaint will be investigated by our office.<\/p>\n<h3 class=\"h2-margins-vertical-equal\">Investigations<\/h3>\n<p>Bi-State Development will promptly investigate all complaints of alleged discrimination on the basis of race, color or national origin in its services and programs within 60 days of receiving a complete complaint. The Complainant may be contacted if more information is needed to resolve the complaint. The Complainant will have ten (10) business days from the date of contact to send requested information to Bi-State Development. Bi-State Development may choose to close the complaint if the requested information is not received within ten (10) business days. A complaint can also be administratively closed if the Complainant no longer wishes to pursue the complaint, or if the complainant fails to cooperate in the investigation of the complaint.<\/p>\n<h3 class=\"h2-margins-vertical-equal\">Letters of Findings<\/h3>\n<p>After the investigation is complete, Bi-State Development will make a final decision and issue a letter to the Complainant based on the investigation findings:<\/p>\n<ol>\n<li>A letter of finding summarizing the allegations and indicating Bi-State Development did not find a violation of Title VI regulations. This letter closes the case.<\/li>\n<li>A letter of finding summarizing the allegations and indicating Bi-State Development\u2019s services or programs is in violation of Title VI. The letter will also contain a brief description of remedies will be taken to achieve compliance.<\/li>\n<\/ol>\n<h3 class=\"h2-margins-vertical-equal\">Right To Appeal<\/h3>\n<p>Complainant may appeal a final decision resulting from a Title VI investigation by submitting a written appeal to Bi-State Development no later than ten (10) business days after receipt of the final decision letter.
